These Terms of Service constitute a legally binding agreement between you and BimaClaims ("Company," "we," "us," or "our") concerning your access to and use of the BimaClaims platform. By accessing or using our services, you agree to be bound by these Terms.

Platform Description

BimaClaims is a digital marketplace platform that connects vehicle owners seeking insurance claim assessments with certified insurance surveyors. We provide technology infrastructure to facilitate these connections but do not directly provide surveying or insurance services.

User Eligibility

To use our platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using our services under applicable laws
• Provide accurate, complete, and current information during registration
• Maintain the security and confidentiality of your account credentials

User Accounts

Registration

You must create an account to access certain features of our platform. You agree to:

• Provide truthful and accurate information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the platform. You may also terminate your account at any time by contacting our support team.

Services and Features

For Vehicle Owners

• Submit vehicle damage claims with documentation and photographs
• Get matched with certified insurance surveyors in your area
• Schedule inspection appointments
• Track claim status and receive updates
• Access surveyor reports and documentation

For Surveyors

• Create professional surveyor profiles
• Receive inspection assignment notifications
• Manage schedules and availability
• Submit inspection reports through the platform
• Receive payments for completed inspections

Platform Fees and Payments

For Vehicle Owners

Platform access is free for vehicle owners. Surveyor fees are paid directly to the surveyor and are typically reimbursed by your insurance company as part of your claim settlement.

For Surveyors

Surveyors may be subject to platform fees or commission charges on completed inspections. Fee structures will be clearly communicated during the onboarding process.

Payment Terms

• All fees are exclusive of applicable taxes
• Payments are processed through secure third-party payment processors
• Refund policies are determined on a case-by-case basis
• We reserve the right to modify fee structures with advance notice

User Conduct and Responsibilities

You agree not to:

• Provide false, inaccurate, or misleading information
• Impersonate another person or entity
• Engage in fraudulent activity or insurance fraud
• Harass, abuse, or threaten other users
• Upload malicious software or viruses
• Attempt to gain unauthorized access to the platform
• Use the platform for illegal purposes
• Scrape, crawl, or data mine the platform without authorization
• Interfere with platform operations or other users' access

Content and Intellectual Property

Platform Content

All content on the BimaClaims platform, including text, graphics, logos, icons, images, and software, is the property of BimaClaims or its licensors and is protected by copyright, trademark, and other intellectual property laws.

User-Generated Content

When you upload content (photos, documents, reports), you:

• Retain ownership of your content
• Grant us a license to use, store, and display your content for platform operations
• Represent that you have the right to share such content
• Are responsible for ensuring content doesn't violate third-party rights

Disclaimers and Limitations

Platform Availability

We strive to maintain platform availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the platform at any time.

Third-Party Services

BimaClaims connects you with independent surveyors. We do not employ surveyors and are not responsible for the quality, accuracy, or timeliness of their services. Surveyors are independent contractors.

No Guarantee of Results

We do not guarantee specific claim outcomes, settlement amounts, or insurance company decisions. The platform facilitates connections but does not control insurance claim processes.

Limitation of Liability

To the maximum extent permitted by law:

• BimaClaims is not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees paid by you in the past 12 months
• We are not liable for surveyor errors, omissions, or misconduct
• We are not responsible for insurance company decisions or claim denials
• Platform users assume all risks associated with using the services

Indemnification

You agree to indemnify and hold harmless BimaClaims, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the platform

Dispute Resolution

Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.

Arbitration

Any disputes arising from these Terms or platform use shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance of modified Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
